In January 2023, OMEGA X won the provisional disposition lawsuit for the suspension of the exclusive contract with SPIRE Entertainment and reached a tripartite agreement for the cancellation of the exclusive contract and the transfer of IP, but SPIRE Entertainment caused a reason for the tripartite agreement to occur due to the spread of false facts. Therefore, we judged that this lawsuit was necessary and immediately filed a lawsuit regarding the cancellation of the exclusive contract through the Korean Commercial Arbitration Board. On March 27, 2024, the Korean Commercial Arbitration Board finally ruled that the exclusive contract with SPIRE Entertainment has lost its effect due to the violation of the "personality rights protection obligation" within the exclusive contract, and the contract has been terminated. In addition, it was recognized that the members of OMEGA X suffered significant mental damage due to the contract violation and illegal acts of Kang Song-hee, the former director of SPIRE Entertainment, and the claim for damages is legitimate. Prior to the ruling, SPIRE Entertainment applied for a delay in the arbitration decision and a resumption of the trial, citing reasons such as the tripartite agreement being caused by tampering, but the arbitrator stated that "It is difficult to see a direct relationship between the tampering incident and the judgment of the effectiveness of this contract, and there is insufficient reason to resume the trial as other cases have been concluded," and clearly stated that the application for resumption of the trial by SPIRE Entertainment was not accepted. Therefore, we have taken steps to nullify the tripartite agreement due to SPIRE Entertainment causing a reason for the tripartite agreement, and if the tripartite agreement is nullified, SPIRE Entertainment must return the 5 billion yen pre-distribution money provided by Danal Entertainment. The YouTube channel "In Jiyoon K-pop idol trainer," which has spread false facts and damaged the personality and honor of OMEGA X members, has been ordered to delete videos and is prohibited from posting videos with the same content. Despite this, In Jiyoon has continued to ignore the court's order and post videos, and we plan to secure all evidence and claim the penalty for the number of days of violation from the court. The 11 members have endured verbal abuse, physical abuse, forced indecent acts, and brainwashing for two years for their second debut and dreams at SPIRE Entertainment, believing it to be their last chance. Despite this, SPIRE Entertainment has continued to commit secondary and tertiary offenses against the members, and the assault case of Kang Song-hee, the former director of SPIRE Entertainment, has been sent to the prosecution and is under supplementary investigation, and the forced indecent act case is also under investigation by the police.
