A woman in her 30s who repeatedly posted insulting malicious comments against IU was given a guilty verdict with a suspended sentence in the appeal trial. Today (31st), according to the legal community, the 9-2 Criminal Appeal Division of the Seoul Central District Court (Judges Hwang Bo-seung-hyuk, Jeong Hae-won, and Choi Bo-won) overturned the first trial's fine of 3 million won (about 330,000 yen) against Mr. A, who was indicted for suspicion of insult, and sentenced him to 4 months in prison with a 1-year suspension. The court also ordered Mr. A to undergo probation and complete 80 hours of community service. Mr. A was indicted for repeatedly posting insulting comments directed at IU through online communities and portal sites. In the first trial, a fine of 3 million won was imposed for 4 malicious comments. However, during the appeal trial, the sentence was increased due to the consolidation of a similar case that had been separately indicted. It is reported that a fine of 3 million won was also imposed in the first trial for that case. The appeal court stated, 'The defendant used insulting expressions that are socially unacceptable towards the victim' and determined that 'the intent of the crime is recognized.' Furthermore, it explained the reasons for the sentencing by stating, 'The defendant has denied the crime up to the appeal trial, has shown no remorse, and has not received forgiveness from the victim,' while considering the fact that similar crimes were repeated. However, the court took into account that Mr. A has a pre-existing condition and that the problematic posts were deleted. Since Mr. A did not appeal, the verdict was confirmed as is. IU's agency, EDAM Entertainment, is continuing legal action against users who post malicious comments.
