One Hundred stated today (24th), 'Regarding the decision made by the Seoul Central District Court on the 23rd to accept the application for a provisional injunction to suspend the exclusive contract, we express our position. The acceptance of the provisional injunction is not a final judgment. The claim that the contract has been terminated is a clear legal distortion. The provisional injunction is merely a temporary measure until the main case judgment is finalized.' They continued, 'We respect the court's judgment. However, we believe that the core materials and counterarguments we submitted were not sufficiently considered due to the rapid pace of the provisional injunction process. We will promptly file an objection and clarify the truth through substantial and sufficient hearings.' Previously, One Hundred argued that they had paid THE BOYZ a high exclusive contract fee (advance payment) and that the members' claims of not receiving settlement fees were not true. One Hundred stated, 'At the time of signing the exclusive contract, we already paid 15 billion won (approximately 1.5 million USD) per member to 11 members, totaling 165 billion won (approximately 16.5 million USD).' They added, 'Even after deducting the unpaid amounts claimed by the members, the members have still received approximately 11.8 million USD in advance.' THE BOYZ's legal representative announced on the 23rd, 'The court today made a decision to accept the application for a provisional injunction to suspend the exclusive contract of the artist. This confirms through the court's judgment that the artist's exclusive contract with One Hundred has been terminated and its effectiveness has ended.' THE BOYZ's side explained, 'The court recognized that the agency violated its obligation to pay settlement fees and failed to fulfill its obligation to provide settlement materials to verify the appropriateness of the settlement, as well as its core obligations under the exclusive contract, such as management support and artist protection. This has led to a breakdown of trust between the parties to a level that is difficult to restore.' They continued, 'Until now, the agency has claimed in media and provisional injunction proceedings that the contract fee has the nature of an advance payment, but the court explicitly rejected this. The court clarified that the exclusive contract stipulates that the payment of the contract fee and the distribution of settlement fees arising from revenue are separate provisions, and there is no agreement that allows the already paid contract fee to offset the new settlement fees that should be paid to the artist. Furthermore, the contract fee is clearly distinguished from the settlement fee, as it is compensation paid to secure a contract with an artist who already had considerable popularity and recognition at the time of contract signing.'
