Furthermore, 'The court recognized that the agency violated its obligation to pay settlement funds, failed to fulfill its obligation to provide settlement documents to verify the appropriateness of the settlement, and did not fulfill core obligations under the exclusive contract such as management support and artist protection, leading to a breakdown of trust between the parties to a level where recovery is difficult.' It was also reported, 'The agency has claimed in media and provisional disposition procedures that the contract fee has the nature of an advance payment, but the court explicitly rejected this. The court clarified that under the exclusive contract, the payment of the contract fee and the distribution of settlement funds arising from revenue are stipulated as separate clauses, and there is no agreement that allows the already paid contract fee to offset the settlement funds that should be newly paid to the artists. Additionally, it clearly indicated that the contract fee is compensation for engaging artists who had already secured considerable popularity and recognition at the time of signing the exclusive contract, and is distinctly separate from settlement funds.' Moreover, 'As the artists have previously communicated through official channels, they plan to responsibly and sincerely fulfill commitments regarding schedules that were already confirmed prior to the termination of the exclusive contract, in order to minimize harm to fans and good-faith third parties.' They added, 'Despite the difficult situation of ongoing false claims and public opinion battles from the agency, the artists have diligently practiced and sincerely prepared for concerts every day. They have done their best while bearing a considerable portion of personal expenses.
