New of THE BOYZ will leave One Hundred, led by CEO Cha Ga-won. According to a report by Sports Chosun today (the 27th), New and One Hundred will terminate their exclusive contract. The two sides reached this agreement on the condition that New would return the contract payment he received from One Hundred when the exclusive contract was signed. Prior to New, the nine members of THE BOYZ (Sangyeon, Jacob, Younghoon, Hyunjae, Juyeon, Kevin, Q, Sunwoo, and Eric) had already left One Hundred. The nine members applied to the Seoul Central District Court for a provisional injunction to suspend the effect of their exclusive contracts, and later received a ruling in their favor from the court. THE BOYZ stated, "The court comprehensively considered circumstances such as the agency’s violation of its obligation to pay settlement money, its failure to provide settlement materials to verify the appropriateness of the settlement, and its failure to fulfill core obligations under the exclusive contract, such as management support and artist protection, and recognized that the trust relationship between the parties had broken down to a level that made recovery difficult due to the agency’s fault." They further added, "Until now, the agency has argued in the media and in the provisional injunction proceedings that the contract payment has the nature of an advance payment, but the court explicitly rejected this. The court clearly stated that, under the exclusive contract, the payment of the contract payment and the distribution of settlement money arising from revenue generation are stipulated as separate clauses, and that there is no agreement allowing the already paid contract payment to be offset against settlement money that should newly be paid to the artist. It also clearly showed that the contract payment is compensation for entertainment activities paid separately to artists in order to conclude contracts with artists who had already secured considerable popularity and recognition at the time the exclusive contract was signed, and that it is clearly distinguished from settlement money." In response, One Hundred said, "The acceptance of the provisional injunction is not a final judgment. The claim that the contract termination has been finalized is a clear legal distortion. A provisional injunction is only a temporary measure until the main case judgment is finalized." It continued, "Our company respects the court’s decision. However, because this provisional injunction procedure was carried out at a fast pace, we judge that the core materials and rebuttals submitted by our company were not sufficiently examined. We will promptly file an objection and reveal the truth through substantive and sufficient hearings." On August 6, the members of THE BOYZ excluding New announced that they had agreed to continue group activities together and had signed a contract for group activities with a new label. The members said, "Individual activities of each member will be carried out separately through companies that can maximize each member’s abilities, but group activities will steadily proceed in parallel with full cooperation. While respecting each person’s individual activities, we will maintain a close cooperative system so that THE BOYZ’s group activities can continue stably." They added, "From the beginning, there was no change in our feeling that the nine of us should continue together. Above all, we wanted to first convey our feelings to the fans who had been waiting for and worrying about THE BOYZ’s group activities."
