To receive a court's judgment again in a criminal trial, an appeal must be filed within 7 days from the verdict date, and it was confirmed that two accomplices charged with the same offense also submitted appeals. Previously, on the 17th, the 11-3 Criminal Division of the Seoul High Court sentenced Tail and the two accomplices to 3 years and 6 months in prison, which is the same sentence as in the first trial. The court also ordered them to undergo 40 hours of sexual violence treatment programs and imposed a 5-year employment restriction related to children, youth, and disabled persons. The court explained the sentencing rationale, stating, "The defendants acknowledged their crimes and this is their first offense," but also considered the "sexual shame and mental suffering felt by the victim." After the first trial ruling, both the prosecution and Tail's side filed appeals. During the second trial, the prosecution sought a 7-year sentence for each of the three, arguing that "the sentence is too lenient compared to the seriousness of the case. Even if the victim consented, the first trial's ruling was excessively lenient when judged comprehensively." In response, Tail's lawyer argued that it was not a planned crime, stating, "They drank with the victim and naturally went to her home, so there was no premeditation." In his final argument, Tail expressed, "I acknowledge all my sins and regret them. The victim's wounds cannot be healed by any words. I sincerely apologize." Tail and two acquaintances are suspected of raping a woman at the home of a foreigner, Mr. A, after drinking at a club in Itaewon last June. It was revealed that he continued with scheduled activities and even did a live broadcast after the crime. Subsequently, SM Entertainment stated, "We understand the seriousness of the case and have determined that we can no longer continue team activities," leading to the termination of Tail's exclusive contract and his announcement of departure from NCT in October of the same year.
