The prosecution has demanded a 7-year prison sentence for former NCT member Tail, the same as in the first trial. The Seoul High Court's 11-3 Criminal Division held the first public hearing of the appeal today (17th) regarding Tail and two others suspected of violating the Special Act on the Punishment of Sexual Violence Crimes (special quasi-rape). In this hearing, the prosecution stated, "The crime is very serious, and its content is extremely malicious," and requested to maintain the 7-year sentence from the original trial. Tail expressed through his legal representative that he is "deeply remorseful" and revealed that the victim accepted his apology. Additionally, acquaintances submitted petitions, stating that Tail's mother had to resign from her job due to the aftermath of this incident, pleading for leniency. Previously, in July, the first trial court sentenced Tail and the other two to 3 years and 6 months in prison, along with 40 hours of sexual violence treatment programs, notification of personal information disclosure, and a 5-year employment restriction in child, youth, and disability-related institutions. Tail and the others are suspected of having raped a foreign woman after getting her drunk at a bar in Itaewon last June, then taking her to an apartment in Banpo-dong in a taxi while she was unconscious. In the initial hearing in June, Tail stated, "I am truly sorry for disappointing everyone," and expressed a desire to make the most of what he sees as his last chance to contribute positively to society. Tail debuted in 2016 as part of the NCT U unit and has also been active as a member of NCT and NCT 127. His agency, SM Entertainment, announced his departure from the group after confirming his criminal conduct last August, and in October, they announced the termination of his exclusive contract. The ruling date for the second trial is set for October 17.
